The agreement between you and GLPMGR

1 Who we are and these terms

GLPMGR is provided by iSafeNet (“we”, “us”), based in the United Kingdom. You can contact us at info@isafenet.app.

These terms are the agreement between you and us for using GLPMGR. By downloading, installing or using GLPMGR you accept them. Please read sections 3 and 11 in particular: they explain what GLPMGR is not and the limits of our responsibility. If you don't agree, please don't use the app. These terms apply alongside GLPMGR's Privacy Policy, which describes how your data is handled.

2 What GLPMGR is

GLPMGR is a personal tracking app for people on GLP-1 medication regimens, on iPhone, iPad and Apple Watch. It helps you log injections and tablets, dose steps, weight, symptoms, water, blood glucose and body measurements (and protein, with Premium), see your progress over time, and set reminders. It is for your personal, non-commercial use. GLPMGR is free to use. Some features need GLPMGR Premium, an optional subscription (see section 5); everything else stays free.

3 Not medical advice

GLPMGR is a record-keeping and reminder tool. It is not a medical device. It does not provide medical advice, diagnosis or treatment, and nobody at GLPMGR acts as your doctor, nurse or pharmacist. GLPMGR never works out or recommends a dose. Nothing in the app, including dose reminders, charts, estimates or projections, should be treated as a recommendation about what, when or how much medication to take.

Figures such as the estimated medication level chart are estimates worked out from what you log. They are not measurements of the medicine in your body. Information about injection areas comes from the manufacturer's product information; it can't tell you where it is safe for you to inject.

• Follow your prescriber. Always follow the instructions of your prescriber and pharmacist, and the leaflet supplied with your medicine. Talk to your doctor or pharmacist before you make any change to your treatment.
• Check what you log. Reminders and charts are only as accurate as what you enter. If a reminder or chart disagrees with your prescription or your medicine's instructions, follow your prescription and the instructions.
• Get advice when unsure. If you have side effects that worry you, or you're unsure whether you have taken the right dose, contact your doctor or pharmacist straight away (in the UK you can also call NHS 111).
• Emergencies. GLPMGR is not for medical emergencies. If you think you need urgent medical help, call your local emergency number (999 in the UK) straight away rather than relying on this app.

This section explains what GLPMGR can and can't do so you can make informed choices. It does not remove our responsibility where we have been negligent (see section 11).

4 Age

GLPMGR is intended for adults managing their own treatment. You must be at least 18 years old, or the age of legal majority where you live if that is higher, to use GLPMGR.

5 Subscriptions, cancelling and refunds

GLPMGR is free to use. GLPMGR Premium is an optional subscription that unlocks the estimated medication level chart, the injection body map, the PDF report for your doctor or nurse, blood glucose charts, side-effect timing patterns, symptoms around a dose increase, protein tracking, progress photos, the body measurements history, body composition trends, Home and Lock Screen widgets (the Progress widget is free), Live Activities, the dose alarm and Protein page on Apple Watch, and Siri and Shortcuts. Everything else stays free, with no time or entry limits: dose logging, dose steps, reminders and supply alerts, weight, symptoms, water, blood glucose logging, the Apple Watch app (Next Dose, Weight and Water; its dose alarm and Protein page are Premium), the free Progress widget and exporting your data as JSON or CSV. If Premium ends, nothing you logged is deleted: it stays in the free views and in your exports. Premium is offered as one of two auto-renewing plans, billed and managed entirely through your Apple Account and the App Store:

• The 7-day free trial is an introductory offer on the Yearly plan only. Apple offers it to eligible new subscribers, once per Apple Account for this subscription group. If you don't cancel at least 24 hours before the trial ends, your subscription starts and you are charged £24.99, then every year until you cancel. The Monthly plan has no trial.
• Prices shown are for the United Kingdom, in pounds sterling. In other countries and regions the App Store sets the local price and shows it to you before you confirm any purchase.
• Payment is taken from your Apple Account when you confirm the purchase.
• Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends, at the price you agreed to.
• If you buy a subscription during a free trial, any unused part of the trial ends.
• Manage or cancel a subscription any time in Settings › [your name] › Subscriptions on your device. Cancelling stops future renewals, and you keep Premium until the end of the period you've paid for.
• Refunds: because Apple takes the payment, we can't issue refunds directly. Refunds are requested from Apple at reportaproblem.apple.com and handled under Apple's policy. This doesn't affect your legal rights (section 10), including your right to a remedy if GLPMGR is faulty.

6 Your data and content

You own the entries, photos and other content you create in GLPMGR. We don't claim any ownership over it. As described in the Privacy Policy, it stays on your devices: there is no GLPMGR server, and GLPMGR doesn't sync it through iCloud. If you turn on iPhone & iPad Sync, your two paired devices sync directly with each other. If you export your data or turn on automatic backups, the file is saved wherever you choose in the Files app, and if that is a cloud service, that service stores it under its own terms. Please check that what you enter is accurate and keep your device secure. GLPMGR has no way to back up or recover data it never receives, so export your data or turn on automatic backups if you want a copy of your own.

7 Your licence and acceptable use

We give you a personal, non-transferable licence to use GLPMGR on Apple devices you own or control, as allowed by the App Store's Usage Rules. A Premium subscription extends this licence to the Premium features. You agree not to:

• Copy, modify, reverse-engineer, decompile or tamper with GLPMGR, except where the law allows it.
• Use the app to store or send unlawful content, or in a way that infringes someone else's rights or breaks the law.
• Try to get around GLPMGR's subscription or licensing mechanisms.
• Use the app in any way that could damage, disable or impair it.

8 Intellectual property

GLPMGR's name, design, text and underlying software belong to us or our licensors and are protected by copyright and other intellectual property laws. Using the app, or subscribing to Premium, doesn't give you ownership of any of it. If anyone claims that GLPMGR, or your use of it, infringes their intellectual property, we, not Apple, are responsible for investigating, defending and settling that claim.

9 Third-party services and data

GLPMGR works with Apple services, including Apple Health (HealthKit) and the App Store. Your use of those services is also governed by Apple's own terms and policies, which we don't control.

If you scan a food barcode, GLPMGR looks the product up in Open Food Facts, an open food database. Information about injection areas comes from manufacturers' product information. We can't guarantee the accuracy of data supplied by third parties, so check labels and your medicine's leaflet where it matters to you.

10 Your legal rights

If you are a consumer in the UK, the Consumer Rights Act 2015 says GLPMGR must be of satisfactory quality, fit for purpose and as described, and that we must provide it with reasonable care and skill. If it isn't, you may be entitled to a repair or replacement, or to some or all of your money back. If faulty digital content we supply damages your device or other content, and we didn't use reasonable care and skill, we will repair the damage or compensate you. Citizens Advice can explain your rights. Nothing in these terms affects these rights, or any rights you have under the law of the country you live in.

Within those rights, we don't promise that GLPMGR will always be available or free of errors, or that any reminder, calculation, estimate or chart will suit your individual circumstances. Estimates are estimates, not measurements or medical advice (see section 3).

11 Our responsibility to you

• What we don't exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your rights under the Consumer Rights Act 2015, or for anything else the law doesn't allow us to limit.
• Foreseeable loss. If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. We are not responsible for loss or damage that isn't foreseeable.
• Personal use only. GLPMGR is for personal use. We are not responsible for any loss of profit, business or business opportunity.
• Things outside our control. We are not responsible for loss caused by events outside our reasonable control, by information you entered that was wrong (for example, a dose, a date or a schedule), or by a decision about your medicine made without following your prescriber's or pharmacist's advice. Where your own actions contributed to a loss, our responsibility is reduced to match.
• Limit. Apart from the matters in the first point, our total liability to you for all claims relating to GLPMGR is limited to the greater of £100 or the amount you paid for GLPMGR Premium in the 12 months before the claim arose.

12 Ending this agreement

You can stop at any time by cancelling any subscription and deleting the app. Because your data lives on your device, deleting the app is also how you delete your data (see the Privacy Policy for details, including copies on a paired device, exports and backups). We may suspend or end your use of GLPMGR if you seriously break these terms. If we decide to stop offering GLPMGR or any of its features, for example if the app is withdrawn from the App Store, we will give you reasonable notice where we can, and you can ask Apple for a refund of any period you've paid for but won't be able to use (see section 5).

13 Changes to GLPMGR and these terms

We update GLPMGR to improve it, keep it safe and follow the law. We may change these terms for the same reasons. If a change significantly affects you, we will tell you in the app or the App Store release notes at least 30 days before it takes effect, unless the law or a safety reason needs it sooner. If you don't accept a change, you can cancel your subscription and stop using GLPMGR before it takes effect. The date at the top of this page shows when these terms last changed.

14 Apple

These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for GLPMGR and its content. Apple has no obligation to provide any maintenance or support for GLPMGR. If GLPMGR fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to GLPMGR. Apple is not responsible for addressing any claims by you or any third party relating to GLPMGR, including product liability claims, claims that GLPMGR fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.

You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when using GLPMGR, such as your mobile network's.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

15 Other important terms

• Apart from Apple (section 14), nobody else has any right to enforce these terms.
• We may transfer this agreement to another organisation, but only if your rights under it are not reduced.
• If a court finds part of these terms unlawful, the rest stays in force.
• If we don't enforce a term straight away, we can still enforce it later.

16 Which laws apply and where you can bring a claim

These terms are governed by the law of England and Wales, and you can bring legal proceedings about GLPMGR in the courts of England and Wales. If you live in Scotland, you can bring proceedings in Scotland or in England and Wales; if you live in Northern Ireland, in Northern Ireland or in England and Wales.

If you live outside the UK, you keep the protection of any mandatory consumer laws of the country where you live, and you may be able to bring a claim in your local courts.
